Las iniciativas contemplan la elaboraci\u00f3n de una nueva Ley de Asilo y una reforma parcial de la Ley de Extranjer\u00eda.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El PEMA establece un nuevo sistema com\u00fan para la gesti\u00f3n de la protecci\u00f3n internacional en los Estados miembros de la Uni\u00f3n Europea. Sus diez textos legislativos fueron adoptados formalmente en mayo de 2024 y son aplicables desde el 12 de junio de 2026.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Una nueva Ley de Asilo<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">En lugar de modificar parcialmente la actual Ley 12\/2009, el Ministerio del Interior ha optado por impulsar una nueva ley reguladora de la protecci\u00f3n internacional.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Entre las principales novedades previstas se encuentran el refuerzo de las garant\u00edas para las personas solicitantes y de la atenci\u00f3n a situaciones de vulnerabilidad, una regulaci\u00f3n m\u00e1s detallada de la protecci\u00f3n de menores y la introducci\u00f3n de un nuevo procedimiento acelerado que deber\u00e1 resolverse en un plazo de tres meses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El anteproyecto tambi\u00e9n incorpora el procedimiento de frontera previsto en la normativa europea y actualiza diferentes aspectos relacionados con el procedimiento de solicitud, la acogida y la protecci\u00f3n de las personas beneficiarias.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Reforma parcial de la Ley de Extranjer\u00eda<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">En paralelo, el Gobierno plantea una reforma parcial de la Ley de Extranjer\u00eda para adaptarla al PEMA en aquellas materias que afectan a derechos fundamentales, incorporan novedades o resultan incompatibles con la redacci\u00f3n actual de la norma. Estos cambios no afectan al sistema de extranjer\u00eda en su conjunto.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Entre las novedades se encuentra la incorporaci\u00f3n del triaje de las personas extranjeras que cruzan las fronteras exteriores de la Uni\u00f3n Europea sin cumplir las condiciones de entrada, as\u00ed como el procedimiento fronterizo de retorno previsto en el PEMA para quienes lleguen de manera irregular y no tengan derecho a protecci\u00f3n internacional.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00bfQu\u00e9 ocurre ahora?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Los dos textos se encuentran todav\u00eda en fase de anteproyecto. Tras su aprobaci\u00f3n en primera vuelta por el Consejo de Ministros, el Ministerio del Interior recabar\u00e1 aportaciones e informes de los ministerios, instituciones y organismos competentes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Una vez finalizado este proceso y, en su caso, incorporadas las observaciones correspondientes, los textos volver\u00e1n al Consejo de Ministros para su aprobaci\u00f3n como proyectos de ley antes de ser remitidos a las Cortes para su tramitaci\u00f3n parlamentaria y aprobaci\u00f3n definitiva.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Fuente: Ministerio del Interior. <em>Interior promueve la reforma de las leyes de protecci\u00f3n internacional para adecuarlas al Pacto Europeo sobre Migraci\u00f3n y Asilo.<\/em><\/p>","protected":false},"excerpt":{"rendered":"<p>The Council of Ministers has approved, at first reading, two preliminary draft laws proposed by the Ministry of the Interior to align Spanish legislation with the European Pact on Migration and Asylum (PEMA). The initiatives include a new Asylum Law and a partial reform of the Immigration Law. The PEMA establishes a new common framework for managing international protection across EU Member States. Its ten legislative instruments were formally adopted in May 2024 and have applied since 12 June 2026. A new Asylum Law Rather than partially amending the current Law 12\/2009, the Ministry of the Interior has opted to introduce a new law governing international protection. The main proposed changes include stronger safeguards for applicants and greater consideration of situations of vulnerability, more detailed provisions for the protection of minors, and the introduction of a new accelerated procedure to be completed within three months. The preliminary draft law also incorporates the border procedure established under EU legislation and updates various aspects relating to the application process, reception conditions and the protection of beneficiaries. Partial reform of the Immigration Law At the same time, the Government is proposing a partial reform of the Immigration Law to bring it into line with the PEMA in areas affecting fundamental rights, introducing new provisions or where the current wording is incompatible with the Pact. These changes do not affect the immigration system as a whole. The proposed changes include the introduction of a screening process for foreign nationals crossing the EU\u2019s external borders without meeting the entry requirements, as well as the border return procedure established under the PEMA for those who enter the country irregularly and are not entitled to international protection. What happens next? Both texts are still at the preliminary draft stage. Following their approval at first reading by the Council of Ministers, the Ministry of the Interior will seek input and reports from the relevant ministries, institutions and public bodies. Once this process has been completed and any relevant observations have been incorporated, the texts will return to the Council of Ministers for approval as draft laws before being submitted to the Spanish Parliament for parliamentary consideration and final approval.
