{"id":8841,"date":"2026-09-11T08:40:47","date_gmt":"2026-09-11T12:40:47","guid":{"rendered":"https:\/\/www.ems-ir.com\/?p=8841"},"modified":"2026-09-11T08:46:18","modified_gmt":"2026-09-11T12:46:18","slug":"spain-grandchildren-law-supreme-court-interim-measure","status":"publish","type":"post","link":"https:\/\/www.ems-ir.com\/es\/spain-grandchildren-law-supreme-court-interim-measure\/","title":{"rendered":"Espa\u00f1a: La medida cautelar del Supremo sobre la \u201cLey de Nietos\u201d no supone su anulaci\u00f3n"},"content":{"rendered":"<p class=\"wp-block-paragraph\">Una reciente decisi\u00f3n del Tribunal Supremo relacionada con la conocida como \u201cLey de Nietos\u201d ha generado dudas sobre su alcance y sus posibles efectos.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La resoluci\u00f3n no anula la Ley 20\/2022 de Memoria Democr\u00e1tica ni supone la retirada de la nacionalidad espa\u00f1ola. Se trata de una medida cautelar que afecta a determinados efectos relacionados con el Censo Electoral de Residentes Ausentes (CERA) mientras se resuelve el procedimiento principal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00bfQu\u00e9 ha acordado el Tribunal Supremo?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Para determinadas personas que obtuvieron la nacionalidad espa\u00f1ola de origen mediante el derecho de opci\u00f3n previsto en la disposici\u00f3n adicional octava.1 de la Ley 20\/2022 y todav\u00eda no est\u00e1n inscritas en el CERA, la tramitaci\u00f3n del expediente continuar\u00e1, pero la inscripci\u00f3n quedar\u00e1 suspendida hasta que se dicte sentencia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Para quienes ya est\u00e1n inscritos, se suspenden provisionalmente los efectos electorales de dicha inscripci\u00f3n para los procesos electorales que puedan convocarse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La resoluci\u00f3n contempla una excepci\u00f3n para las personas respecto de las cuales los Registros Consulares puedan acreditar directamente el supuesto de exilio previsto en la Ley 20\/2022, sin aplicar la presunci\u00f3n establecida en la Instrucci\u00f3n de 25 de octubre de 2022.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Por tanto, estamos ante una medida provisional sobre determinados efectos censales y electorales. The ruling does not repeal Law 20\/2022 on Democratic Memory or revoke Spanish nationality. It is an interim measure affecting certain aspects of the Electoral Census of Spanish Residents Abroad (CERA) while the main proceedings remain pending. What has the Supreme Court decided? For certain individuals who acquired Spanish nationality of origin through the right of option established under Additional Provision Eight.1 of Law 20\/2022 and have not yet been registered in the CERA, their registration process may continue, but registration will be suspended until a judgment is issued. For those already registered, the electoral effects of their CERA registration are temporarily suspended for any elections that may be called. The ruling provides an exception for individuals whose circumstances can be certified directly by the Consular Registries as meeting the exile criteria established under Law 20\/2022, without relying on the presumption set out in the Instruction of 25 October 2022. The decision therefore represents a temporary measure affecting certain census registration and electoral effects.
