Spain: New Measures for Return Authorizations During Summer 2026
Spain’s General Commission for Immigration and Borders has issued Instruction 1/2026, introducing specific measures regarding return authorizations in response to the increase in travel during the summer period.
The instruction addresses the seasonal rise in applications, which can lead to delays in other immigration procedures as return authorizations are prioritized during peak travel months.
As a key development, an exceptional regime will apply between June 8 and September 30, 2026. During this period, certain foreign nationals will be allowed to enter Spain through land or maritime border checkpoints provided they can present:
- A valid passport or travel document.
- An expired residence permit.
- Proof that a renewal application has been submitted.
This measure also applies to holders of student residence permits who are currently renewing their authorization.
However, the authorities have clarified that this flexibility does not apply to air travel. Travelers entering Spain by air must continue to obtain a return authorization in advance to avoid issues with airlines.
The instruction also reminds travelers that a return authorization is only valid for entry through Spanish border control points. It cannot be used to enter the Schengen Area through another Member State, and entry may be denied in such cases.
In addition, the instruction introduces a specific provision for UK nationals and their family members covered by the Withdrawal Agreement. Under this measure, return authorizations may be requested even if the application is submitted up to 90 days after the expiration of the Foreigner Identity Card (TIE), ensuring the continued exercise of their free movement rights.
These measures aim to optimize administrative resources and facilitate the mobility of foreign nationals whose residence permits are currently undergoing renewal during the holiday season.
