United States: Federal Judge Rules $100,000 Fee for Certain H-1B Visa Petitions Unlawful

A federal judge has ruled that the $100,000 fee imposed by the Trump Administration on certain initial H-1B visa applications was unlawful. The H-1B program is widely used by U.S. companies to recruit specialized talent in fields such as technology, engineering, healthcare, and research. The decision represents a setback for one of the most debated immigration measures of recent months and renews discussion about access to the U.S. labor market for skilled foreign workers.

The decision was issued by Federal Judge Leo Sorokin of the U.S. District Court for the District of Massachusetts. The judge concluded that the federal government lacked the authority to impose the fee through a presidential proclamation, finding that the charge functioned in practice as a tax, which can only be authorized by Congress.

The H-1B program allows U.S. employers to temporarily hire foreign professionals in specialty occupations that generally require a university degree or advanced technical expertise. It is one of the primary pathways for highly skilled workers seeking employment opportunities in the United States.

According to documents submitted to the court, only 85 payments of this fee had been recorded since the measure took effect, highlighting its limited use.

The White House has already announced its intention to appeal the ruling. As a result, the case may continue through higher courts, and the ultimate status of the measure will depend on how the litigation develops over the coming months.
