Chile: New Guidelines on Successive Temporary Residence Extensions
Chilean immigration authorities, through the National Migration Service, have recently clarified the rules governing the continuity of Temporary Residence permits. As a general rule, most temporary residence subcategories may be renewed consecutively, provided that the conditions under which the original permit was granted remain in place.
Under current regulations, these permits may be renewed for periods of up to two years on a consecutive basis, without an automatic legal obligation to apply for permanent residence after accumulating 48 months of temporary residence. This interpretation aims to provide greater legal certainty and flexibility for foreign nationals who have chosen to establish themselves in Chile under this immigration status.
However, the regulatory framework establishes specific exceptions. In the case of seasonal workers, the regime is more restrictive, allowing only one additional extension of up to two years, after which the permit expires.
Likewise, the special permit granted to foreign women during pregnancy is considered a strictly temporary measure and cannot be extended. Therefore, it is necessary to arrange a timely change of immigration category in order to maintain regular immigration status in Chile.
Finally, it is important to note that all extension applications must be submitted within the ninety (90) days prior to the expiration of the current permit. Compliance with this deadline, together with continued compliance with the eligibility requirements, is essential for approval of the application by the immigration authorities.
