Spain: Digital Nomad Residency Requirements for Company Owners and Self-Employed Professionals

Spain’s international remote work residence permit is also available to self-employed professionals. However, applicants who operate through their own company must be able to demonstrate the nature of their professional activities and their ability to work remotely.

Under Law 14/2013, applicants must meet specific requirements relating to the company’s business activity, their professional relationship with overseas clients or companies, and the conditions under which their work is carried out.

What do applicants need to demonstrate?

The key requirements include:

  • Established business activity: The company or group of companies with which the applicant has a professional relationship must have been operating for at least one year.
  • Professional relationship: Applicants must provide evidence of an ongoing contractual relationship with one or more companies based outside Spain for at least three months before applying.
  • Remote working arrangements: Supporting documentation must confirm that the professional activity can be performed remotely, including the applicable terms and conditions.

Why supporting documentation matters:

  • For self-employed professionals operating through a company, the application must clearly demonstrate both the existence of genuine professional activity and the arrangements under which that work is performed.
  • Reviewing the applicable requirements and preparing comprehensive supporting documentation is therefore an essential step before submitting a residence application.
