Spain: New Transparency Requirements for Employment Contracts

Royal Decree 723/2026 came into force on 5 October 2026, introducing stricter requirements for employers to provide clear and detailed information about employment terms and conditions.

Under the new rules, employers must be more specific when communicating essential employment conditions, rather than relying on general references to collective bargaining agreements.

What information must employers provide?

The main requirements include:

  • Pay: A breakdown of basic salary and individual salary supplements.
  • Job details: Information on duties, professional classification and workplace location.
  • Working time: Details of working hours, schedules, annual leave and overtime.
  • Probationary period: Its duration and applicable conditions.
  • Automated systems: Information on the use of algorithms or automated systems that may influence employment decisions relating to working hours, task allocation, pay or termination of employment.

Greater transparency in employment relationships

The reform requires employers to provide clearer and more comprehensive information about employment conditions, reducing the need for employees to rely solely on collective bargaining agreements to understand key aspects of their employment.
